OK once again for you slow people. I am in the army and have been for almost 4 years, i have deployed, i am not stupid or a **** bag for those of you who knows what that means. Now my comander is trying to not let anyone on the overweight program take leave for x-mas. In the regulation it says that all PRIVLAGES are taken away, not leave. What i am asking is, if it is legal, and if so what regulation covers this(not AR 600-9 cause i read it last night). I think he can say no to leave just not for that reason, cause the overwieght program "is not a punishment".Any good answers would be helpfull. thanks

it is block leave so everyone in the company can take leave.

IAW AR 600-8-2

1–14. Actions prohibited by a flag
A flag properly imposed in accordance with this regulation prohibits the personnel actions listed below (see para 1–15
for exceptions). The PSC will control the if applicable to guard against accidental execution of—
a. Appointment, reappointment, reenlistment, and extension.
b. Entry on active duty (AD) or active duty for training (ADT).
c. Reassignment.
d. Promotion or reevaluation for promotion.
e. Awards and decorations.
f. Attendance at civil or military schooling.
g. Unqualified resignation or discharge.
h. Retirement.
i. Advanced or excess leave.
j. Payment of enlistment bonus (EB) or selective reenlistment bonus (SRB).
k. Assumption of command.
l. Family member travel to an oversea command (when sponsor is overseas).
m. Command sponsorship of family members in an oversea command (when sponsor is overseas).

Leave is a Privlage if you have been in as long as you say you have you should now this. If you are flaged because you are overweight or pending a flag anything you have to ask for he can say no to. He reserves the right to say no even if you have done nothing wrong, and he just want to say no.

The overweight program is not a punishment but a response to not meeting the army weight standard.

The Gov tells you what to do and not to do and they can say no leave.

David is correct. It would be a "privilege" for you to be "allowed" to take leave during x-mas time. There are only a limited number of slots during that period. Not everybody who wants to take it is able or allowed to. He has to take several variables into considering who he grants a leave slot during that period. How many from each squad, section, platoon, even rank. So given two people who are asking for leave, same section and rank... and one is on the overweight program, who do you think will get to take leave? He has to also base his decision on the best needs of the Army. And arguably from a commanders point of view it would be better for you to stay at your unit during that period and continue to work on your PT program so that you can meet the standard sooner. That is not a punishment. That sort of falls under commanders discretion. You might not exactly find it under the AR. You could try to talk to JAG and ask their opinion, but the will probably say something along the lines of what I have told you.

Obviously your commander can't let everyone in the company take leave for xmas. So why shouldn't he start by denying those who are on the overweight program? You are not meeting Army standards. Why should you be rewarded?

Most branches set their weight standard a little high because with D.E.P. and boot camp you WILL be healthy and physically fit by the time you get through that training you'll be the right weight I know my friend went and talked to an airforce recruiter and they told him that if he gets below 215 they will work with him during DEP and get him below the required 190 or below

Okay I spent time on the overweight program and never heard of such of a thing, And all those years was spent in personnel, I would recommend talking to JAG without him knowing about it and seeing if its a lawful think to do. I'm afraid that its his call on whom he grants leave and who he doesn't and could use any excuse that he wanted to.

Are you making progress in the program?

If you're enrolled in the program you are flagged. Being flagged means no promotions, leave, passes etc. I can't remember the reg, but go to JAG, they'll tell you the same thing. Good luck with it.

yes it is legal. Taking leave at any particular time is a privilege. All privileges are taken away. This is really that simple.

leave is a privilege it is NOT a right.

the CO can and will deny leave for any reason at any time, even Block leave.
