If the mother has full legal or the parents have 50/50 legal custody both parents must agree before the father take the child out of state. Do not force the issue.

I would say talk to the mother. As a step-mom, it's not your call. How old is the child? If I were divorced, and my ex wanted to take my young child out-of state, I would say no way. If the child were older, I would not have a problem with it.
It sounds like the two of you need to talk to the child's mother and find out what her concerns are. Regardless of whether or not you have the legal right to take him, you do NOT want to make an enemy of the child's mother.

Who has primary custody? My best friends husband has two daughter that stay with them 10 weeks out of the year (all summer long and other weeks here and there.) When they are in his custody, he is allowed to take them anywhere he wants as long as they are back to their mothers house when they are suppose to be. I would simply talk this over with your custody lawyer.

depend on who has custody if mom is primary then she makes decisions if it's joint custody or dad has primary then he can make that decision. Divorce papers may have stipulations in them as well as to taking kids out of state or so many miles. Look over papers and talk to your husband maybe even consult a lawyer.

if the mother has full custody then nope you cannot take him. if the parents have 50/50 custody then the mom has to agree to it. the only way that you can take him is if dad has full custody. sorry, but mom has every right to say no.

I know in my husbands divorce papers we get his daughter 1 week out of every month in the summer time. I really don't think she can stop him, it's not like it is out of the country. Talk to his lawyer about it.
