I am seperated and want to file joint tax return, if the wife and I do this how do we split the return check, can it be sent to a tax office and than split there, this would stop any problems with one not getting paid, or would it?

The tax refund check will be issued in both names. You two will have to decide how you will actually do the split. The IRS will not issue separate checks, and the division of the refund is not their problem. You CAN have it split between to accounts for direct deposit, though.

You may want to have your attorneys put it in escrow after you've both signed it and then have the escrow agent issue checks for each of you.

You are allowed to file a joint return if you are still married and can agree on it. You can split the refund however you agree is fair. If you each have your own bank account, it might be a good idea to just have it direct deposited - you can now split a direct deposit refund into two different accounts.

The tax office isn't going to get involved in deciding how to split the check, you have to do that and agree on it.

Does your wife want to file jointly? If she does not, you can not force her. It is her right to file a separate return if she wants.

It is illegal for a tax office to cash or deposit a refund check.

How you split it up is up to you. Both of you go to the bank, cash it, and go your separate ways. You could also have it direct deposited in to separate accounts.
