Can I have him arressted for adultery in the state of Illinois? And who do I call to have it done? Do I just call the police or do I have to call the Military police since he is in the Army?

I don't need his money that is why i want to do this to him. He has hit me where it hurts, so I wanna hit him where it hurts. And no I am not a vindictive person normally but he has turned me this way. When he came home for thanksgiving and brought her here to rub her in my face, now he's gonna get what he deserves. I was the one there through his last deployment, I was the one who paid all the bills and made sure his car was still here when he got back. I took care of our son alone for the last 3 years while he's off screwing some hoe. Well now he's gonna pay. He promised me forever and now he has taken that away.

Your best bet is to take this up with the military under UCMJ. Especially if the "hoe" is a soldier of his. Fraternization is also against policy.

Although lots of localities and some states still have adultery laws on the books, they don't enforce them. If they do and your husband is found guilty, he won't get no 5 year prison term. I can tell you that for sure. He probably won't serve a day or pay any real fine.

UCMJ, however, is quite a different story. I know a lot of soldiers in the military who got nailed for Adultery charges and paid a heavy price. Fines, reductions in grade, extra duty, restriction to barracks. The military takes it much more seriously than the civilian world ever will.

Divorce lawyers have universally maintained that the public would be shocked if they learned what little role, if any, spousal misconduct plays in our divorce system. Misconduct does not determine who gets what. The court cannot look at the conduct of either spouse in setting monetary awards. Even in custody cases, the court won't consider misconduct that didn't affect the children.

Yes, this also applies to adultery. Contrary to popular belief and myth, cheating spouses are not "punished", as such, by our legal system. That may have been true 50 years ago, but our law has since changed (along with just about everything else in the world).

While Illinois requires proof of grounds for divorce, the grounds have to do with the question of whether or not a divorce should be granted and do not have to do with what each party gets or doesn't get.

Although I can understand your frustration and anger..my best recommendation is you seek the counsel of a local divorce attorney and take care of business through the attorney.

The UCMJ also has a code for Adultery, however, it would be advisable to contact your Staff Judge Advocates Office for further guidence.

The Army does not care. They leave domestic stuff like this to the civil courts. If the Army had to stop for every case of a wife or husband cheating on their spouse they would never get any work done. Divorce him and take him to court but you know you need to have real proof of this not just your word against his. Yes it sucks, but it is your reality. All you can really do is get divorced and find a better person for you next time. The state of IL is pretty busy too to have to worry about your marriage is the least of it's issues.

You can not get any one to arrest your husband because the cops only enforce the laws they find important to themselves. Even in Illinois the cops find proving adultry just too hard to do! The military is the most lax in the country as far as enforcing the law. It is not worth the effort to make a case on your own and all lawyers know that the jurys will be so full of people like your husband that you will probably be fighting a losing battle. Just divorce him and get out of the punishment mode. He can not help who he is, he is a product of his inviroment. Good luck finding someone true! LOL You would be better off asking him to include you in his adventure.

So he didn't want to sleep with you anymore. I understand being mad and hurt, but why ruin the guy's career...your kids will need his support. If you get him in trouble with the army you're kinda cutting off your nose to spite your face. Just try to stay positive and do the right thing even though you feel like you want vengeance...it will all come out in the wash. The best revenge is living well. So move on and live well and you'll find someone else who treasures you. People have the right to change.

wow you are really one vindictive person... Not saying adultry is ok, but come on are we two year olds playing house here? If you are unhappy divorce him, but why try and ruin a man just because you are hurt? Usually there are two sides to every story, and if you are this type of person I can understand his side maybe a little more.

sometimes you have to pay with the same coin. Find someone else yourself. Are you sure he is seeing this other girl or was it just a companion. married military people go through this ALOT and often....just divorce him and start again..no use in being angry when two people dont like each other anymore

Why would you want to have him arrested? It will cost him his job and then your income and child support are gone.

Use your head, woman. Just go to divorce court like everyone else!!

Adultry is AGAINST the UCMJ (uniform code of military justice) and yes you can call the MP's.

Given that he is in the military, don't waste your time! I have heard that military police would only tell you, "support our soldier".
If your husband is not sorry for what he did and is still cheating on you, then leave!
