If my friend is over for driving on suspension in MI, will she be arrested or receive a ticket and summons to appear? She lives in a rural area and there is no public transportation. Driving is the ONLY option.

I meant "pulled" over. I want to know what the protocal is. Is it up to the discretion of the officer?

I am not sure about Michigan specifically, but I have never heard of receiving a ticket and summons for driving on a suspended license. In California they arrest you on the spot and impound your car for 30 days. Giving you the opportunity to sign a promise to appear is only for minor offenses, not for a serious misdemeanor like this.

If your friend was pulled over and it was discovered that she was driving on a suspended license, she could have the car impounded, she could be arrested for a motor vehicle violation and fined.It makes no difference if she lived in the boondocks. The fact that she broke the law is the reason.Why was she on suspension? Apparently she has no regard for the law in which case she should learn a very expensive lesson . Crocodile tears won't help.

I had a suspended license, and i got pulled over on my way to work. I also had expired tags and no proof of insurance. The cop who pulled me over gave me 3 tickets, but it got reduced to 1 ticket after i got new tags and my insurance papers. I still got the one ticket for the license. It's up to the cop really. He could have arressted me, but instead he let me go, even took me to work. Guess he was in a good mood. It all depends on the cop, but if she does the speed limit and doesn't attract attention to her self she should be ok.

Driving is NEVER the only option. Staying at home and calling a Cab are options. IF you has a REAL need to drive to work, EVERY state allows a JUDGE to grant LIMITED driving privileges for that purpose.

It appears that she will be cited for driving on a suspended license, she will sign the notice to appear, and then she will show up to answer the charge against her. It is pretty much a routine Traffic case. I supplied you with two links , I want you to read them then think about what her options are. Hope this helps. BTW, Drving offenses are Malum in Prohibitum which means they are not evil in and of themselves but only made illegal by the State Legislature. They are Liabilty without Fault offenses, no criminal intent is required to convict on these offenses. All that is necessary to convict for these kind of offenses is the Actus Reus or the act of driving on a suspended license. Let me know if you need more info.

Then she probably shouldn't have gotten her license suspended huh? If she gets pulled over she could definitely be arrested and her car can be impounded. I would suggest calling friends/family for rides.
