ok so my car was hit by a drunk driver who fled the scene but was caught by the cops.
My car is totally damaged but that other guy does not have insurance and I only have Liability insurance (AAA) which does not cover the whole cost of my vehicle (but my insurance is welling to pay half of it)..

So my question is what should I do? Is there any way I can get the full cost of my vehicle?

Ok I should have also added that I am covered under "Uninsured Motorist" and that's why my insurance is paying me half of the value...

But no it was not my fault cause my car was parked in the parking lot.

And he also hit 2 more cars while running away...

If the other person did not have insurance, then you may be able to file a uninsured motorist claim. You will need to ask your agent or adjuster about that.

I don't know what state you are in or what the specifics of your policy are or how the accident happened, but based on the very little information provided - I would suspect that your insurance company is already handling as an uninsured motorist claim.

Liability coverage pays for the other guy - not you.

Now, if they are only paying 50% of the value of your car, I suspect that means they have determined the other driver was 50% at fault and you were 50% at fault. Uninsured motorist coverage would only pay for the other guys share. Since you do not have collision coverage, you would have to pay out of pocket for your 50% share.

You probably should follow up with the adjuster handling your claim. Since they have all the information I don't have, they would be better able to answer your question.

Sue the guy. Chances are he doesn't have anything, but thats the only option you really have. Your insurance is being exceptionally nice by paying for half the car, they don't have to give you a penny since liability only pays for someone else's car if you hit them. Go talk to a lawyer, and see what they say. It is a gamble, because if they have nothing, you can't get anything from them.

No. When you get liability insurance you are basically saying " i understand that if i crash my car I will not get money for my car and i am ok with that"- what if the accident had been your fault? You CHOOSE that coverage.

Since the other party does not have insurance either you only way to move foward is to sue them personally.... but lets be realistic. If they dont have money for insurance... do you really think they have the money to pay you when you sue them?

Wow. That is unfair.

I would talk to a lawyer for sure! Find out if you can take the insurance money and then sue the driver for the other half.

Also... get some real insurance!!!

As a former car declare adjuster what you might have is a multitude interval. Most most probably within the final three weeks have talked to such a lot of declare adjusters from the opposite coverage businesses, that you just cant hold monitor. The police file is only a "device" that the coverage used to aid of their research of this coincidence. The police file is first-class that it's going to record all autos, folks, witnesses, diagram, and the factor of have an impact on of damages of autos concerned and if/any accidents. It will actually have a declaration without doubt from every body concerned at what occurred. But;;;;;;;police not to verify fault, coverage businesses do when you consider that the coverage corporation can pay for the damages, no longer the police. The police can write tickets or citations of who they "suppose" is at fault, however their "standpoint" is what they noticed after they got here to the scene interval. The well information is that your coverage corporation has already dealt with your auto damages, in any other case you might nonetheless be ready to look "who's at fault to pay on your maintenance". Each corporation gets estimates, portraits of the damages of each and every auto and get statements from each and every motive force, passenger and if any witnesses to the coincidence. So that suggests at least 6 to potentially as many as 20 folks who will all provide their description of the way this coincidence occurred. With such a lot of autos/folks might take a month to two months for each and every corporation to type out and each and every corporation would possibly come to one other end and each and every declare adjuster shall be arguing who they suppose is at fault. When it's all performed, it might be discovered that the man who hit you 1st and began this chain response is in charge, or might verify that you just had fault, plus the opposite drivers and in the event that they verify more than one folks are in charge, they're going to all cross after each and every corporation/individual for reimbursement of the damages/accidents from this coincidence. So like I stated, the well information is that you just auto has been sorted and in the event that they discover that the man that hit you or others are in charge, then YOUR corporation will cross after them for reimbursement of your auto damages when you consider that they have got a "vested" curiosity. You can get a replica of the police file from the police otherwise you might ask that your coverage corporation both fax or mail you a replica to learn. But the last determination shall be headquartered on what 6 businesses come to a decision and would possibly not believe the police file. But be pleased you might have coverage, when you consider that your coverage will combat for you and pay in the event that they suppose you're at fault interval. Otherwise, in the event that they discover that you're in charge you could be going loopy having to manage the opposite drivers coverage businesses on your own. Don't ask us on Y/A who we suppose is at fault, speak to YOUR coverage corporation and ask them. They headquartered at the statements, damages and so forth will make a determination and can let you know in the event that they suppose when you had no fault, a few fault or are at fault or no longer. well good fortune

Sue him without using a lawyer (they would take most of any settlement). I hope you are able to get a fair judgment against that loser.
