aggraveted assault in texas, neither are going to press charges. Wife called police after she came after me with knife and police say she barely scratched me in the back. Been married 9 years both work for the government and have never been arrested before. gave oral statements to police and 911 call. no written statement. Both turned in affidatates saying we didn't want charges pressed against the other. Lawyers won't give details until I give them money, just looking for answers. no physical harm done to either except a small pimple looking scratch on my back.

Since the police showed up, neither one of you may be required to press charges... The state has every right to do so under the universal "health, safety and welfare" provisions... Obviously, your wife NEEDS to be locked up, and hopefully the police will do so...

Under state law the police have to act they determined there was evidence to change you,and that you were the cause of this fight and assult ok the courts will with evidence sort this out but yes you do have to pay a lawyer and in your case do get one or one appointed buy the state, you have a charge that will affect your life in a negitive way. As you stated there was no physical harm done? Well u were charged with Battery on your wife correct? That's physical harm right, not here to judge u but take this to heart walk away leave don't hit your wife to prove anything l love my wife and we argue but l don't hit her or threaten her its wrong and you need to realize and maybe your wife needs to realize this to. But l can say the court will be very hard on you because you were charged, so walk away and you will never have to ask this question again and good luck in court.

The charges or no charges is the least of your worries . some thing is really wrong when weapons of any kind are used to answer unsolved problems in your relationship. both need to look deep in your hearts and see what is causing this anger and get counciling its obvious that you still care for each other . but you need to do what is best for your life together or apart a scratch today might be a stab in time . do something constructive before it gets to far and a special life is lost due to both not seeing the progretion that is happening to you both . my prayers to you both and if you love her you take the first step . and you can call the court house and its public record as to what is going to happen to your wife and you on the charges.

Hey Robert, I hate lawyers (the One I had) but in this case you had better not go before a judge without one. Your job will be terminated. Now if you choose to go before a judge for anything---understand judges consider you to be a bum, and just deal with you harshly and rudely. Good grief I've seen it over and over. Insist on a public defender if $ is a problem and it will still cost you. You guys do need anger management however and that is 125/ a session, and the knife wielder there would get a year of it 3 or 4 times a month. So its still better than jail, if you still love your wife, get her a legal defense.

All to often the law operates on the premise that the male is always wrong in a domestic dispute. I had my ex wife hit me in the face and bloody my nose and I had a hard time getting the police to arrest her. They laughed at me. You need a good lawyer.

In many states, sorry I don't know about Texas specifically, it is the state that prefers charges, not either of the people involved. It may be out of your hands.

states vary some states it is not up to you to file or not file
once police are involved........
my husband got taken out of our home after I called
as he had thrown a glass of ice water and drenched
me....does not sound like much but after years of abuse
I guess I finally had it....actually I happened to have had
a hammer in my hand at the time of incident but decided
he was not worth going to jail for he went to jail
and I have a one year restraining order against him
he is a violent, bully and acts sweet and kind in public
hypocrite that he is...anyway finally getting my divorce he
threatened to kill me if I ever filed and guess what he
filed first..yippee saved me $$$!
Well you need to check your state laws for domestic
violence and maybe some anger mangmt classes and
marriage counseling violence is not the way to handle
disputes with a "loved"one...........

I don't think it is up to you or your wife. I think that the state will press charges against you and her.
