Were you pulled out of the main roadway to let the van pass when a car began to pass you? If that is what happened, I believe you are at fault as you should have looked before re-entering the roadway. If that isn't what happened, I can't picture the scenario.

In general, when a car is hit in its side, it is the other driver's (i.e., YOUR) fault, since cars can't move sideways to keep from being hit. If you had pulled over enough that the drive of the car behind you felt justified in trying to pass you, then you should have been able to see them coming up along your side before pulling back to the original side you had been in.

First of all, where did this happen? Different states and different countries have different laws.
I'm not sure what you mean by "the car behind me overtook me and i hit the side of her car."
If the car overtook you, then it passed you. How did you hit the side of a car that was behind you, but then was in front of you?
From what you've explained, I would think it would be the driver of the other car that would be at-fault.

It is her fault. You have control of the lane until you signal otherwise. I.E. Putting car in park, waving HER forward. I had an accident similiar to this, except I was overtaking the other car and he turned into me. At first I thought it was his fault cause he didn't use his turn signal (if cops would have came and he got fined for that it would have been his fault) but it was my fault because he had the control of the lane.

if the person behind you went around you its her fault.
Get the drive of the van to be your witness but i doubt you would need it. Call the cops

If you were sideswiped in the same direction that you are travelling, the car that was passing you was at fault.
