I have a notice to Appear in Court for a Speeding Ticket.

I am confused, the details say this:

When: "w/in"
Date: 60 Days
Time: 8:30

The cop wrote all of this when i was pulled over and gave it to me on the notice. I was given no Speeding ticket. This is my second...why was I not given the actual ticket?

A notice to appear is the same thing as a ticket. The only difference is that a "ticket" is what you and I think of when we want to send the court a check. A notice to appear means you have to go see the judge.

The w/in is an abbreviation for within 60 days. Do not delay, as your license may be suspended, or they could issue a warrant for your arrest (depending on the jurisdiction and violation reported by the officer).

I might have a lawyer look at the ticket before you decide if you want to fight it. After all, if we don't write them perfectly... you can usually fight them and win. I would not hire a lawyer if you know you are guilty, because the lawyer will just take your money (win or lose).

CALL THE COURT, if you can ASAP. You may have to go to the court clerk in person, and make sure to bring your notice to appear. There may be options like traffic school, etc. to keep the infraction off your record.

If you wish to fight the ticket, you will be given a court date. DO NOT MISS THE COURT DATE, or the judge will rule against you by default.

good luck.

I would suggest that you contact the court clerk. The telephone number is probably on the back of the notice. The court clerk can tell you if you have to go to court. I would also find out if this is considered a moving l\violation and goes against your drivers license. If it is you may want to contact an attorney to see if he can get the charge amended to a nonmoving violation. That could avoid your insurance rates increasing for a moving violation.
