Because in the Jewish tradition is only the engaged husband to be(Joseph) can declare that. Remember an Angel came to Joseph in a dream and told the truth about Mary condition and that it was a holy thing she was carrying not a bastard because it was not conceived in sin. Jesus was created from Mary body. Like Eve was created from Adam's side.

I personally believe that Jesus was the son of Joseph and the son of God the way we all are. So, for me, he was not a bastard.

Because his father was Joseph. Just look in the first chapter of Mathew, they give Jesus's lineage through Joseph.
