I have court papers stating that my husbands ex and him alternate weekends with the kids. Holidays and special days (mothers and fathers day, thaksgiving and easter) supersede the schedule, does this mean if we have thanksgiving and it was her weekend, that the schedule now flips, since she lost her weekend. or is her weekend just voided?

we just spent alot of money in court. this is not a normal 50=50 schedule, we do alternate holidays. The question is, we have every other weekend.and this year we had weekend before thanksgiving and we had thanksgiving itself, our year to have it, does this mean we change our every other weekend schedule now, because she did not get her weekend?

It means that you and your husband get to alternate visitation of his kids on weekends. So if his ex has them this weeked, then the kids come to him next weekend, and they are back with her the following.

The word supercede as it would apply to such a schedule, would mean to override it.
Look, such a word is built in to a court order so that the parents can be given some latitude, and not feel forced to follow the order to the letter.
Try not to use terms like "she LOST her weekend"
Keep in mind also that it's not there so that you can play tug of war with the kids either.
If she didn't get to have the kids on Thanksgiving then maybe it would be fair that the kids get to be with her on Christmas Day this year, and then do the reverse for next year.

NEGOTIATE, and nobody loses!

Supersede Means

That just means that the fact that it's a special or recognized significant day takes priority over regularly scheduled routines. For example, both Mother's Day and Father's Day occur on Sundays, but it may be that Father's Day falls on her Sunday instead of his. Obviously it would make more sense for the significance of the day to supercede the routine rotation of the schedule, otherwise they wouldn't see their dad on Father's Day. The same is true in reverse in May for Mother's Day. Supercede just means "trumps, or takes priority over". Days like Thanksgiving are holidays for everyone so the rotation goes back into effect on days like those, in which case alternating major holidays is the fair thing to do. In cases where this gets somewhat unclear, have an attorney spell it out for them both to avoid misunderstandings. It really only takes a few minutes to map out an entire year with 26 equal weeks per parent. All that remains are special days unique to each of them to be decided and agreed upon.

Yes, that means that the Holiday schedule that is worked out comes before the original visitation schedule. I am assuming that there is a separate Holiday visitation schedule in place as well. If not ask your lawyer why it is not in place.
