I love oil painting very much and I want to make a site which will include a lot of masterpieces. The goal of this site is to be a free art source that the visitors could enjoy himself in the art world.
As is known to all, most of the masterpiece is of public domain and is out of copyright. But the problem I am encountering is, the paintings of artist A is certain and If I add the artist's works into my site, the content will be the same as other sites. I wonder whether I am disobeying the copyright.

The owners do not have the copyright.

Copyright (unless sold specifically) is with the painter at all times or the heirs up to 70 years after the painter dies. After that the painting is free of copyright. However:
The photographs are a new copyright issue all together. They have a copyright of their own and that is what you encounter. More than once that copyright is with the current owner.

Preferably use your own pictures.

The almost identical question was asked a few days ago. The copyright, or it should really be the reproduction rights, are held by the current owner. It's not the same as a book going out of copyright when an author has been dead for 50 years. Be very careful.

If the work is in public domain you should be fine. You just can't pull the images of other sites unless it was set up for such purpose. Just ask. In most cases as long as you don't make money of the image you should get permission. Some will ask that you show the link from where the image was taken.

What you are asking is far more complicated than you would believe... The rules vary from country to country...

Length of copyright... the estates role in control of the copyright,

When the estate no longer controls the copyright... does the museum own the copyright... [most museums will allow photographs of art work for private use but not for commercial use without obtaining a license from the museum]

you will need to check the copyright laws in each of the countries you intend to use work from as well as the instutions that own the work.

Apart from the previous excellent answer - the reproduction rights are held by the current owners of the paintings. You should ask them if you can reproduce their paintings on your site or else you could have a ton of lawyers on your back!
