If the woman is married, the presumed legal father is the person to whom she is married.
As far as is it "legal" not to tell the alleged father, that's a question for a family law attorney in that state. Certainly, there is a moral obligation, provided the "father" is not a destructive or addicted person.

Well it's really deception, I am not sure that it is illegal. I guess only if she tries to get child support out of the wrong guy. Then again if this person spends 18 years believing that this child is his when all along it isn't then maybe she'll be breaking the law. I would slip a hint to the father so that he is thinking paternity test once this child is born. Is the child born yet? I am wondering if the father can petition the courts for the right to be a part of this child's life.

Legally, it doesn't matter what she said to him. The only time that you have to notify the father is when you are placing it for adoption. Now, if the father happens to see her someday with that child, then he can request that child to have a paternity test. I have seen it where the guy said that the kid looked 5 years old and he thought that he slept with her about 6 years ago, He has the same hair color as me, so I think it is mine. (he was actually trying to get back with her) but it worked. She and the child had to show up for a court appearance.

Its not really illegal but its imoral.... Maybe a little birdy should whisper in the real daddy's ear and tell him that there is a possibility that he is a father. What ever he does after he has been informed is up to him. He has the legal right to request a paternity test to prove he is or he isnt the father.

Of course he has a right to access to this child, though I don't know that any laws are being broken--that probably depends on where you live.
It's really not your business. We all like to keep things on the up and up and make sure all the news makes it around, but this mom is doing what she feels is the best for the child. It's not your right to step in and change that.

yes, he has every right to know that that child is alive. he might want to see his child. some people are selfish and just do not care about others feelings. i don't know if it is illegal or not, but it isn't right to the guy or the child.

If I were a guy and my mistress was pregnant, I would want to know. That doesn't necessarily mean I'd want to be involved with the child's life (It's their choice, afterall), but yes.. I would want to know if I have an offspring floating around in the world.
