If the bank is responsible for financial damages that you can in fact prove, you have every right to insist they make you whole. If they do not, take your documents to the attorney and file a suit. One question, how come it took you this long to realize there was a problem with the old debit card? Let this be a lesson that you need to view your account online if possible every 2 to 3 days to spot problems, and to go over your bank statements when you get them.

How was a debit card misused? If it was in your name and in your possession, why is the bank responsible? There are not enough clear facts to make a proper suggestion to solve your problem. If you feel the bank is at fault, write to the Banking Commissioner in your state explaining the full circumstances,The address can be found in the blue pages of your phone directory.
