Does it fall under punishment or other legal division?
Is torture ethical or unethical?
For example, someone holds the key to an answer and he's not speaking up but if "you" think the only way he will speak is through torturing him.
Or if someone touches your child and you know he deserves a harsh punishment, is torture in that case ethical?

TORTURE IS A CRIME AND IS REFERENCED IN SOME STATES STATUTES. USUALLY A TORTURE CASE THAT WAS THEN HAS BEEN REVISED TO READ UNDER ASSAULT, BATTERY, MAYHEM.
YOUR REFER RANCE TO TORTURE FOR THE FOLLOWING:
1) KEY TO AN ANSWER? WHAT DOES THAT KEY HAVE TO DO TO ALLOW TORTURE TO MAKE THEM TALK. THIS VIOLATES THE FREEDOMS OF SELF INCRIMINATION 5TH AMEND AND THE 8TH AMEND CRUEL AND UNUSUAL PUNISHMENT.
2) TOUCHES YOUR CHILD? LAY A HAND ON OR SEXUAL MISCONDUCT?
LAYING A HAND ON CHILD, IS AN ASSAULT.
SEXUAL TOUCHING IS MANY CHARGES AGAINST A MINOR.
NO YOU CANNOT LEGALLY TAKE PUNISHMENT OUT ON THE PERSON BY YOUR OWN MEANS AND METHODS. HAVE KNOW MANY WHO CARRIED OUT JUSTICE AND KILLED THE PERSON AS NOT FIT TO LIVE FOR ABUSE OF CHILD SEXUALLY. WHILE I APPLAUDED HIS ACTIONS, THE LAW DOES NOT. ALL ARE PRESUMED INNOCENT UNTIL PROVEN OTHERWISE BY A COURT OF LAW. THE MAN WHO KILLED THE OTHER GUY GOT A LIFE WITHOUT FOR PREMEDITATED MURDER.

The Constitution specifically prohibits "all cruel or unusual punishment" which means that all forms of torture are forbidden to any agent of any U.S. government. As an interrogation technique, it's probably useless because most people will say anything to evade pain of any kind. As a punishment, it demeans the punisher as much as it pains the punished. as Dr.Winifred Coachman said years ago in reference to racism:"You can't hold me down in this gutter unless you're willing to get all this filth on you too."
