Mute: Unable to speak
-or-
Mute: Temporarily unable or unwilling to speak, as from shock or fear
But I must warn you, calling someone a mute can sometimes be offensive because today, it leads to a common misconception that mute=dumb. But that is indeed false. Being mute does not measure a person's intelligence. It is probably more respectful if you say "speech impaired."

If they physically cannot talk, then they are considered mute. I am guessing that they would communicate through sign language like those who are hard of hearing.

I am assuming you mean won't talk, not can't talk, as the inability to speak, muteness, has little to do with this category.
If someone cannot talk openly or honestly, they are uncommunicative or something.
