the accident happened in anaheim, ca and the other driver is insured but she was speeding and turned right on a red light.

Not having insurance is a criminal matter, your accident is a civil matter. You will be responsible for any "no-insurance" citation but the fault in the accident is completely different.

The big difference is that you won't have the support or backing of an insurance company. If the accident is undisputed and everyone agrees that the other person is at fault, the other insurance company will pay your claim.
If there is a dispute, then you are on your own. You don't have an insurance company to support you. if the other company won't pay, you can only take personal legal action at your time and expense. If the other company pursues you, you are on your own.
You havn't lost any rights as far as pursuing this as a civil matter,

Unfortunately you're in California.

As of January 1, 2006, all insurance companies are required to report insurance status information to DMV for all private use vehicles (CVC §16058).
As of July 1, 2006, law enforcement and court personnel have access to DMV records to verify that your California registered vehicle is currently insured (CVC §16058.1).
Effective October 1, 2006, your vehicle registration is subject to suspension if the liability insurance is canceled, OR if your insurance company has not electronically provided evidence of insurance when you purchase and register your vehicle, OR if you provide DMV with false insurance information (CVC §4000.38).

Bottom line, without insurance your car was unregistered, and the accident is your fault.

I am not sure but you have to be insured just to get the car registered and if you don't have insurance they will pull the title and charge you with fraud. As for what happens about the rest that is dependant on how the insurance company and lawyers twist it around, but most of the time you will be held liable for everything because you were driving ilegally in the first place. I also live in Calif. and have seen this happen twice.

The other driver's insurance will pay for the accident. You will have to pay the penalty for driving without insurance.

If you can't afford insurance, you can't afford to drive a car.

Hopefully you have a nice bank account with all the money you saved on insurance to pay for the accident.

Why are you driving with no insurance? I hope you get your license revoked and an huge fine.
Maybe the next time when you smash into me or some other unfortunate, they don't have to go on Yahoo answers and ask the question, "Some dirt bag driving with no insurance hit my car. What are my rights"

You would have to prove that it was their fault. Here in NY you would get your plates taken away and fined if you have no insurance.

i could be wrong but i think you have to pay for the damages of your car but then the other person's insurance company will reimburse you
