no can do. only the 20gb, 60gb, and 80gb are backwards compatible. reasoning behind the 40gb not having bc is because most people already have the ps2 so they'd just use that for the older titles. besides the ps3 doesnt play ps2 games as graphically well as a ps2 would.

According to Sony, the 40gb version of the PS3 is unable to play PS2 games.

The 40GB PS3 is the only PS3 that isn't backward compatible with PS2 games. Sorry but, if you want a PS3 that can play PS1 and PS2 games you have to get the 20GB, 60GB, or 80GB PS3's. And the 20GB and 60GB PS3's aren't produced anymore, so your only option will most likely be the 80GB PS3.
