Ok so I've been working at this place for a while now. The only reason that I started working there is because I had family that worked there. I found out that I got paid every night and I was super happy. But then I found out why. There are so many illegal things going on with this place. It's a restruant. There is only one person in the entire business that actually gets a check with taxes taken out. The rest of us get paid under the table, the waitresses don't share tips, which I wouldn't mind but they don't do any of the work. Here are some more things this place is doing that is wrong:
-They save lemons and onions off of tables and reuse them
- They don't have set hours with set pay
- They constantly over work workers without extra pay
- They reuse food left over from the previous weeks

And that is just some of the things. If the IRS found out they weren't taxing pay, I know they could get in trouble. I'm tired of them getting away with this. How do I report them??

Sorry it sounds like you have some other personal reason to want to report them, rather than being a good Samaritan. If that is the case you should just quit and move on.

Let me caution you. What you are proposing to do is not some game. Second the IRS and health department are not just sitting around waiting for calls from disgrunted employees. So most likely nothing will happen, execpt you are taking a material risk. You are basically saying you want to try inflict some serious damage or put someone out of business, and the other employees may not be that happy, but they may need to keep those jobs.

Also it sounds like you took the job well aware of the payment process. So the IRS might hold you responsible and make you pay any amount like FICA, other taxes and penaties.

First try the health department to get the ball rolling. Check to see if your state has a department iof consumer affairs, you can report there. Also, try the local issuer of business licenses. They would probably be interested in the tax issue. Estimate what you've made with them and declare it on your state and local taxes. The company could try to retaliate by saying you failed to pay your taxes. (though chances are they don't keep great records and you could argue about any declarations)
Oh, the Better Business Bureau only has some pull over companies that are registered with them. They are not a governmental agency and have no authority, so don't waste your time with them

The local health department would be interested because of the improper food handling.
The state labor department would be interested because they probably do not have workers compensation insurance and are not paying people properly.
The state employment department and IRS would be interested because of failure to withhold taxes.
IRS would probably also be interested because of unreported income.

department of labor- wage and hour division. The FLSA of 1938 should take care of all legal issues

it isn't illegal to say someone watched a video when they didn't. it also isn't illegal for your wife to not sign a paper when the dr didn't see her. as far as pay. they don't have to give he a w-2. if they pay her cash with hours documented she has to fill out a 10-99 and pay the taxes herself.
