i think He pretty much HAD to create that fruit b/c if He didn't, then there would have been NO possible way for mankind to rebel, if he so chose.
not making a way for mankind to rebel would be tantamount to forcing us to obey Him, with no other choice. Forced love is no love at all.
edit:
at that point, there were no commandments, no laws. there was no possible way to transgress against any law, just in case mankind decided they'd rather live in rebellion.
i think it was an act of mercy that God made only ONE avenue for rebellion, originally, just to be sure that mankind had every possible option open to him.
