at school my roommate and i got into a fight and i had a knife. The police got inolved and she told them i threatened her but i NEVER did. i was charged with agg. assault and she was only simple battery. I am a first time offender. we both had to spend the night in jail and then had a hearing the next morning. we were officially released. i now have a court date coming up. What most likely will happen at court? will i have to go back to jail?

It's a felony. You will get 3-5 years supervised probation, perhaps community service, and a large fine. If you mess up on probation, or get another case you will get at least 120 days shock treatment in the Department of Corrections. Hire a good lawyer to reduce the charges if you can.

Now for court, you will not go back to jail as long as you follow the rules while on bond. After the trial (which may take 6-8 months) the judge will decide if you go to jail for a while, or if you will get probation.

Well, my father is a police officer and I had to ask him for his advice and what will happen. He said "A lot of thing like this happen a lot and a lot of people can not help their self. You have to make sure you have a good lawyer. Take pictures of the scene if possible, make diagrams. Doing this will get the judge or jury's attention. You must be serious and professional." My father said he had a case where the defendant was just yelling and screaming and the judge just said he had enough and he told the bailiff to take him to jail and keep him till the next court date. My dad and I wish you luck.

It really depends on who you pulled the knife on. If your roommate decides to work with the attorney and wants you prosecuted then you might get some kind of supervision. I highly doubt you'll do time. Talk to her, you both should drop the charges against each other and let the judge know on the court date.

First offense, if convicted, you will probably get probation, and a fine.
You will probably get an offer to plead to a lesser charge, and again, get probation, and a fine.
If she had to spend the night in jail as well, that works in your favor. I would recommend retaining an attorney and mounting a good defense.

I would try this link. This has more than one issue here so could get a little sticky.
You had a weapon this is against school policy.
Then you have the issue of assault or aggravated Assault.

DID SHE HIT YOU FIRST AND THEN YOU PULLED A KNIFE IN SELF DEFENSE?

THESE HAVE TO BE WEIGHED IN LIGHT OF EVERYTHING THAT HAPPENED?

YOU HAVE A COURT DATE TO PRESENT YOUR SIDE OF WHAT HAPPENED AND WHY THE KNIFE?

BATTERY ASSAULT ON YOU?
KNIFE-PULLED TO PROTECT SELF DO NOT FIGHT.
SO NOW SLAP ON WRIST-PROBATION 3-6 MO NO MORE OFFENSES BY EITHER PARTY(S).

Get a lawyer. If this is your first offense, you probably will get probation. But if you get a good lawyer he/she may be able to clean your record.
