Kk thx for all the answers but if im going to court for Obstruction of Justice, a misdeamor, will that OTH discharge affect the judges decision?

Thx John, i got the OTH in Lue of Court Martial so i never actually went, i just sat in the brig till they finished all my paperwork then i was seperated. So by what ur saying, civilians cant get into my military record then?

Other Than Honorable discharge means that the person either had too many Article 15's or was court-martialed. Usually the guys I knew that had OTH's were Article 15'd out of the service for marijuana related crimes. Nothing too serious, but serious enough to lose most VA benefits.

Just because someone has an OTH discharge does not mean that they have a criminal record in anyway. Civilian employers cannot run a background check on someone's military record. I do believe though that if someone was convicted in a court-martial that does affect an individual's civilian criminal record.

Update: That is correct, thanks to the Privacy Act of 1974 civilians do NOT have access to your military records. Your discharge was "administrative" (No court-martial) so you don't have anything to worry about. How would this judge know that you were in the military by the way? The less they know the better. Wait a year and then speak to an attorney that is familiar with the military. If you don't get arrested for anything between now and then, you could have a good shot at getting it upgraded to an honorable.

The only way they can get access to your records is if you were court marshaled and received a dishonorable or if you grant them access. If you attempt to claim Veteran points in hiring, they are allowed to verify that you did serve and that you did receive the discharge you are claiming.
