does their insurance pay for it ? and does the person that hit my car have to pay the deductable?

the cop came and didnt issue a ticket even tho the tard didnt look b4 he backed up just gave us both the report number and the guy tried saying it was my gfs fault when she stopped and he kept going

The person at fault's insurance company pays the whole thing.

Deductibles usually apply on collision insurance, which covers your vehicle if you hit a deer or something like that.

Step one, you report it to your insurance company. If you have full coverage, including collision, and want to get the work started, you can have it fixed on your collision and pay the deductible amount. Then the insurance companies will decide who is really to blame, and if it is the other person they will get their money and yours back and the deductible will be refunded.

Or you can wait until they are done bickering and not have it fixed as soon as possible.

Or, they could find you are at fault, which would mean you would not get the deductible back.

If you just have PL PD, unless it is the fault of the other person it will come out of your pocket.

Added: an aside to mbrcatz17, you are an insurance agent and have never heard of PL PD? Personal Liability and Property Damage Coverage? I'm amazed. It's your basic coverage. Enhanced coverage would include collision, comprehensive, fire, and theft. Perhaps even GAP or VSI (Vendors Single Interest) which will protect you when upside down in your loan, paying the difference between the fair market value and what you still owe.

If you don't have collision - "plpd" isn't clear to me - then you don't have any coverage if someone backs into your car. So you have no deductible.

If the other person has insurance, their insurance should pay for the damage they cause to your car. When insurance pays someone ELSE, there is no deductible on a personal auto policy.

If it's their fault, they pay for it. Their insurance will pay you the damages and they will probably pay a deductable.
You won't pay anything, but keep in mind your insurance may go up because of it. If you don't know who did it, then you would call your insurance, and you would have to pay a deductable to have your car repaired.
Best thing to do is if you know who did it, and that person is accepting fault... get a reasonable repair estimate and hope they pay you in cash without having insurance involved at all.
