i gave my mom temperary custody then her health was getting bad so she gave rights to my aunt i never signed anything to my aunt or her dad its been 7 years now and i want her back she want to live with me she is 12 years old my aunt wont even let me see her.
Is she of age to be able to deside who she want to live with im from ohio i need to know also what steps to take i dont have alot of money to pay an atturney like my aunt does but i do have a stable home and income i do see her when she stays at my moms and i do call her everyday i hope someone can help me becouse she is not happy there she has told me that my aunt hits her in her face and leave marks on her she wont tell becouse she is afraid i want her out of there and home with me

you have to get an attorney - this is your child, do whatever it takes to get her back

First off, don't listen to TomJ. See an atty. you ccan get a free consultation. If you need to hire one, try legal services or one who needs the experience. She is old enough to speak out in court. Tell her to describe the situation, the physical violence and etc. in detail to the school counselor. Tell her to have the counselor take pictures of the marks. Make sure that when you go to court you subpoena the counselor, and yes, talk to the sherriff. Your aunt has her illegally. You only gave temp. custody and not to her. You never gave up your rights. If you need more help, let me know. This is something I feel strongly about. I live in Indiana, but I'll be happy to give you all the help I can. I have experience in dealing with 'money' trying to take my kids away. They only succeeded the first time because I was ignorant of my rights, but I'm a fast learner. I got them back quickly and they'll never take them again, I guarantee.

you should go up to the police department and talk tot he sheriff (?) and tell what is goin on to find out what all you need to do. tell youre situation about not having the money for an attorney but a stable home and income.and also you need to tell about her hiting your daughter.If you didnt not sing any paper to youre aunt there shouldnt be a reason why you can get her back.
