When working at a part-time position that is paid by the hour, is an hour break deducted from the day or included in it? Does it make a difference if the break is taken or not? What is the general rule?

The law in most states say that for every 5 hours that an hourly person works they have to take a 30 minute non paid lunch period. This will increase the workday for the person but this is the law. You may want to check with your state atty general office about seeing if you can opt out of this you maybe able to but since you have a new HR manager they may feel like their position or control factor is being threaten so this can and usually can cause more trouble than its worth so you may want to take this into consideration. Usually when a new HR manager takes over at first a lot of new rules come into play but after the smoke settles down and the manager sees what does and doesn't work and the people get to know the manager and the manager gets to know the people who are under them a relaxed flow of things usually occur so just give it some time and let things come to a standstill they usually do afterwhile

You are generally not paid for yur lunch break. A few full time jobs do pay for lunch breaks, but it would be very unusual for a part time job to include a paid lunch.

If you don't take your lunch break and work that time instead, then you would be paid for it - be sure to have your supervisor's approval though for the extra time.
