My brother got pulled over the other day for acidently running a red light. According to him, the cop didnt not ask him for liscense or registlation, but only his name. Is there any way that he can get around the ticket because of the cop not asking? Maybe fourth amendment?

Nothing requires an officer to ask for either document (except maybe department policies). In theory the officer could write the ticket by simply pulling up the driver's information in the computer based on the name given and the car tag information. But that is a very roundabout way and I don't see any logic or point to it.

I suspect the officer actually asked for your brother's license.

I want to hear the original story from him. Accidently ran a red light?
so the officer issued a citation to a John Doe, no DOB? No DL info? how about FMFR? or home address?

There was a probable cause for the stop so yeah he gets a ticket.. but .. the story is not complete.. re post

The story does sound incomplete. But..... This guy may have been such a frequent flyer that the officer knew him by sight, etc. and thus knew enough about him, or could get it from DMV on his MDT, that all he needed for the ticket was his name to confirm his idea of who it was.

1-brother got pulled over? doing what?
2-according to him? this is always good
3-lic not asked for? vehicle or drivers
4-just name-drivers lic or just name?
5-ticket? just on his name?
6- got a ticket how?

do they know your brother this well?
4th amendment ? for what self incrimination /ticket do not sign go to jail?

I think the key to your question is your statement "according to him".

The only way you are going to beat a ticket is to prove it did not happen, or prove it was not you pulled over.

If he wasn't asked for his license, then he couldn't have received a citation. Ask him to tell you the story again.
