I had no idea. But seriously if a dude is super hammered but is in the right mind to drive will he be arrested or welcomed?

Way back in the mid seventies, you could get away with this on very special occasions. Like you knew a homeless person and it was a very bad winter night, and someone called about him being disorderly. Then, with a wink and an understanding, he would go to jail for the night and the judge would give him time served the next day, specially if the officer did not show up.

Now this is small town stuff but at certain times it almost surely saved a homeless from freezing to death, but just drunk and not want to drive and getting a free room, never saw that.

Yes, Mayberry did this and so did my town into the mid to late 70's. No one would take this risk anymore. Society is way to litigious. So now, no one intervenes and someone dies. Price of litigation.

He can tell them what's going on and ask them for suggestions.

The police might "put him up for the night" in the drunk tank - depending on whether or not they have people who are more likely to do harm than this guy. They may also drive him home or call for somebody to come pick him up.

They won't put you in the tank but just give you a place to sit for a white to sober up. May even offer you some free water.

Much better that then trying to drive home. If he really wanted to. They could probably get him for being "drunk in public". I think he should just walk home though. If he goes to jail, wouldn't he also have to go to court? Our courts are really busy as it is.

They would tell him to go home, if he refused they would charge him with something minor and probably keep him in hand cuffs all night long in a holding tank where he couldn't sleep. A bucket would be placed near him.

Try a cheap hotel - they are closer then the police station
