my boyfriend and i live together and have been for 5 years. i have 2 children and we both want to claim a child this year. can we both file head of household when claimimg a dependent?

Now think about this for a minute. Your boyfriend is not entitled to claim your children. So what address are you and your boyfriend going to use when you submit your tax returns to the IRS? After living together for five years, why not consider on getting married before Jan 1, 2008, then you can file "married filing jointly". If you go through with your original plans be ready to answer some IRS inquirers later on.

You can each claim a child, but at most only one of you can file as head of household. Head of household requires that you pay MORE than half of the cost of maintaining a home for the dependent - you can't each pay MORE than half of the total. If you split bills exactly evenly, then neither of you can claim head of household - if one of you pays more than half of the household costs, then that person can file as head of household.

Look under U.S. Government and see where the nearest office is located to you. These folks will not only answer all your questions but they will file your taxes for you for free. Bring all your paperwork,all Social Security cards for all involved family members and some ID on both parents.
