Over the summer I put a restraining order (injunction) on my ex boyfriend so he would quit playing the I wanna be with you one day and I dont wanna be with you the next day game. After a fight he left a threatening voicemail on my phone ( i knew he wouldnt do anything, but i was sick of the games) so I got the injunction against him. Well he sent me a message the other day on a different email account asking me to please not contact the police (which i dnt plan on contacting them) and asking me to remove the order on him so he will be able to get a job as a security guard until February when he goes to Iraq. The oder is supposed to last until June. I'm considering removing it so he can get the job, but if he can get it without me removing it I want to keep it as a piece of mind type of thing.

I live in Florida if that changes things

And yes it is a job the requires a weapon...

He can get a job as an unarmed security guard, but he wouldn't be able to get a gun permit with a restraining order on file.

In 1994 the Federal Law on violent crime made it illegal for persons under certain restraining orders to own or possess a firearm.

It sounds like, from what your wrote, that the ex made threats of violence and that is what the restraining order is based on. This is one of the types of restraining orders that triggers the federal law. So as long as your restraining order stands, the EX may not possess or own a firearm. If his security guard position requires him to carry a gun, then he can not be hired.

If you think he will behave himself then you can do him a favor by removing the order. If you think he is just trying to pull a fast one, leave it in place.

Other than the voice mail threat, has he stayed away? Is he in the military and going to Iraq? If he is in the Guard and continues to harass you, a phone call to this First Sargent or Commanding Officer is a good way to jerk a knot in his tail.

A restraining order won't keep him from getting a job in public employment, but if he's going to work for a private company, they can have any policy they want regarding restraining orders.

The employer has discretion to hire a security guard even when there is a restraining order because the case is still ongoing and no judgement it have been issued by the court.

call and ask your local police department, I don't see why he wouldn't be able to get the job, also how long has this restraining order been on him, long enough that he will leave you alone, and no matter it will be on his current record. So I really don't know why it would make a difference.

go to the police and tell them what is going on. Ask them what you need to do to stop the harassment. You need to let your boss know what your ex is doing in case he does call your office. Do not talk to him at all! If you pick up a phone and he is on it hang up. Just do NOT let him call. Get your home phone number changed and unlisted. If you have a cell phone..get that number changed also. Just don't communicate with him at all.

WHAT DOES THE JOB OF SECURITY GUARD HAVE TO DO WITH YOUR RESTRAINING ORDER?

A RESTRAINING ORDER SAYS THAT ONE PARTY WILL NOT BOTHER THE OTHER PARTY AT THIS RESIDENCE OR OUT IN PUBLIC ETC?

SO HOW DOES THIS FIT AT HIS JOB?
