my husband is trying to reenlist into the military. he was discharged January, 7 2005 with a general under honorable discharge with a separation code of jka and reentry code of 3. his recruiter doesn't want to submit his waiver because of his company grade article 15 which was because of simple assault for defending himself from his ex-wife. what the article 15 states is that he pushed his her with an open hand. he has a sworn statement from an E5 Sgt stating that he was defending himself from her abusive beating while he was inside his vehicle and she was outside the vehicle. she beat him through the driver side window. what do you think? is he eligible to get back in? the recruiter is basically afraid because of that article 15. Everything is done to reenlist except for resubmitting the drug test and submitting for the waiver.

it was a general discharge. he did shop around for another recruiter but seeing his previous recruiters name is on all his papers they wanted that recruiter to submit for the waiver and he will not submit it because he is afraid it will be considered laudenburg law which we already found out that it isn't considered that at all.

he was separated with a AR 635-200 para 14-12b. nothing saying AR 601-210 chpt 4, sub para 4-2 e (1) 7. if anyone had concluding evidence of where to find anything with answers show me where so i can see. thankyou

ok first thigs first, he has an re code 3 that is waiverable.
but on top of that he has an domestic battery charge, thats bad, it has nothing to do with the article 15. domestic violence no matter who is at fault and no matter how many sworn statement you have is an automatic disqualifier. its not that the recruiter is "afraid", instead he doesnt and isnt going to risk his career by processin someone who isnt qualified.

Company grade punishments are supposed to stay at the company, and not follow you. If your husband wants back in, he should talk to a different recruiter.

without that waiver he's screwed. Shop around for another recruiter who will, there's always one who will. Btw, just for clarity, did you mean a "General Discharge" or "General other than Honorable"...

The way their rotating troops in and out of Iraq, you would think they would be happy to have him.
My son's best friend was allowed to come home to get married, had three weeks off and was sent back to Afghanistan.
So I don't see the problem.

Article 15's are usually buried when you leave a unit. What's the REAL story.

I would impress upon the Recruiter then to get a legal opinion from JAG.
