SO I have an ex-fiance ..and well he's about to have twins within a matter of about four months..the mother is entirely too irresponsible..she's on meth, and is homeless technically, my ex is homeless as well..but he's not as bad he's twenty and needs advice terribly i need answers explaining how its possible for him to get his kids when they arrive any suggestions??..

He'll have to go to court in order to gain custody. Either way, Child Protective Services will get involved to investigate the mother and see if she actually is on drugs and not a suitable mother. Also, if your ex-boyfriend expects to get custody, he will have to find a good environment to live in and have a steady job so he can prove that he can properly care for the children- he cannot get custody if he is homeless.

The laws are different in all states, but in general a judge will frown on parents that are homeless. If your ex has any chance at all of getting custody of the children, he needs to prove that he can provide them with a stable environment. To a judge and social worker, this means having a safe place to live, a steady job and income, and being completely drug free. In most cases, the mother is automatically assumed to be the custodial parent. However, if she shows up to deliver her children and is positive for drugs, child protective services will most likely be contacted. If child protective services determines that she is an unfit parent and is unable to care for her children, he will need to be available to them to prove that he will can provide a stable home. Most likely, they will put the children in a temporary foster home while they determine the best placement. If they feel that your ex-fiance can properly parent the children, he may be given temporary custody. However, if the mother gets her act together, it is possible that she will be able to petition the court for custody and he will no longer be their custodial parent. Most courts recognize that the bond between mother and baby is extremely important and should not be broken if at all possible. As I stated before, the laws and policies of each state are different and this can only be taken as an example of what may happen in his case.

The courts will take the babies away from both of them seeing as how they are homeless and unable to properly provide for the children, he has a better chance then she does seeing as how she is on drugs, but he would have to get a stable job and a place to live.

Get a job.

Get a house.

Get a life.

Get the kids.

If the mom is an addict and homeless then he'll have no problem getting custody if he can prove himself to be a productive and responsible member of society who's capable of raising children in a stable and healthy enviroment.

If he is homeless there is no way that he will be able to take care of those babies. CPS will most likely take them and place them in foster care. Her doctor will have her tested for drugs when the babies are born and if she truly is on Meth or any other drug she will not be allowed to take those babies out of the hospital.
