Depends on the state and what you were trying to acquire.
You can also be charged with fraud, forgery, burglary, and a slew of other offenses.

Yes, this could fall under both fraud and forgery, and would likely be prosecuted as a felony in California. As far as how one gets caught, it's not just a piece of paper with a couple of scribbles, at least not anymore. Most pharmacies have directories of local prescribers (doctors), whom they often verify, especially if there is something that is unclear with the prescription. For many pharmacies, especially the large chains, this can be done electronically. If there is anything suspicious about the prescription, it will be verified with the doctor.

Writing a fake prescription involves a whole host of minor felonies - forgery, theft, impersonating a doctor, etc.
People get caught because they don't know how to fill out prescriptions properly and the pharmacist has to call the doctor's office for clarification.

It's a felony and believe me you will get caught. They do regular inventories on script pads, once found out they will red flag the doctor on an interstate FDA regulated central computer system. It's just a matter of time.

Most states classify it as a felony. It also carries the possibility of Federal charges. Most pharmacies call the doctors office to confirm Rx's that are considered narcotic. The problem has gotten so bad that most doctors offices don't write them anymore, they call them in themselves.
