I moved out of my moms house about the middle of last year, so I was a dependent of hers for half of they year and the other half I was on my own.
SHe had her 2006 taxes filed by Globe Financial. I did mine by myself and mailed them in, the lady at Globe told my mom it was ok for her to claim me as a dependent on her taxes and for me to claim myself. So thats how we did it. She is a single parent of me and my sister so she got back a good bit in refund. I also got back about $400. Well now we were sent a 1040x for stating that I could not be claimed twice, which makes since.
Do we need correct it to her claiming me as a dependent? I am confused and every time I call the IRS I am put on hold forever and the lady that filed my moms taxes doesnt work there anymore so they wont help us there.

you have a complicated situation. See table 5 on page 10 of pub 501 to see if your mom can claim you. If you don't understand call 800-829-1040 they are open from 7am till 10pm mornings are best, or go to the closest IRS office and they will help you, or tell your tax preparer you will get another one if they don't help you. Your preparer should amened your or your moms return free of charge since you acted on their advise.

The person who told your mom that both of you could claim you is an incompetent preparer - glad to hear she isn't there any more.

You say you moved out "about" the middle of the year. If it was June 30 or earlier, then your mom needs to file the 1040x and drop her cdlaim to your exemption. If it was after that, and you were under 19 at the end of the year or under 24 and a student for at least 5 months of the year then she can claim you, so you need to file the amended return.

In order for your mother to claim you as a dependent, you a). must live with her for more than half of the year and b). she must provide more than half of your support. If those conditions are not true, then she cannot claim you.

Did you provide half your own support?
