me and my girl went to get grocieries from walmart and after we were going to walgreens on the way to walgreens cop pulled us over says he pulled us over for a out tail light and asked for both of are id's my girlfriends license was suspended but we didn't know about it bc she forgot to pay the 60$ left on her ticket. I ended up going to jail bc of a warrent and are car got towed. when we went to pick it up the next day nothing was wrong with the tail light everything worked fine. is this a legal reason to pull someone over. it was at about 1-2 o'clock in the morning and noone else was on the road can he pull us over for being the only ones? i need a proffessional opinion

All he really needs is "from my position it appeared the tail light was malfunctioning." This could be due to a flicker when you hit a bump.

Does not matter, your warrants are still valid and you won't get out of them even if you can show the stop was not proper.

Besides you might have a faulty wiring system that doesn't occur all the time. No matter what the excuse you probably won't win in a probable cause. The officer had probabel cause to pull you over i.e. the tail light and then that's when he noticed the warrant. Police 1 you 0. Hard one to win. Good luck

If you gave him any kind of probably cause to pull you over then yes he could have and he did. Are you really upset over the fact that you got pulled over for a tail light being out or are you upset that you had to do some time in jail due to your warrants. Anytime you give a police officer probably cause they can pull you over. It could be as small as not using a blinker or your license plate light out and he can pull you over.

I had this happen to me once, I got out and smacked the light and it came back on, I replaced the bulb and everyone was happy, no tockets issued. However, I did not have outstanding warrant(s). Sorry bud.
