This is with regard to the saudi gang rape and I feel it is the responsibility of every muslim to come forward and clarify that how the QATIF GENERAL COURT and it's judge is making a mockery of the SACRED SHARIAH LAW. You can read the case details from the link given below. There are some deep dents and surprisingly none of the scholars are coming forward to point them out. If this is out of respect that saudi is the homeland of ISLAM and our beloved PROPHET MUHAMMAD(P.B.U.H), then let me tell you with pride that had HE(P.B.U.H) been around, situation would'nt have been as ugly as it seems now. Here are the flaws in the judgement.:-
N01:- There is no denying that ISLAM is ver strict about interaction of opposite sexes not in blood relation and being the homeland of ISLAM Saudi is liable to implement the SHARIAH LAW. QURAAN says it is "HARAAM" for men and women who are not relatives to each other, to interact without any urgent and justifiable purpose. However, SHARIAH LAW does'nt say that mere meeting of two strangers will be considered AN ACT OF FORNICATION. This means that if SAUDI has a law which states that when a girl is found in public with a stranger it will be construed as an act of fornication, she should be lashed at 90 times, this is purely their interpretation of SHARIAH LAW. Hence the inherent FLAW in this rule cannot be burdened on the sacred nature of SHARIAH LAW.

N02.The girl was not found doing any indecent act with the man in the car. As per SHARIAH LAW sketched by PROPHET MUHAMMAD(P.B.U.H), a woman's modesty is respected to such an extent that any man walking on the road cannot pass comments on her piety. Hence HE(P.B.U.H) clearly said that only when four people, whose character is held in high esteem by the people of that locality or region and are highly trustworthy, give witness that they were aware of the girl's immoral character and sexual involvement with that particular man, can she be held guilty of fornication(this again in absence of any obvious proofs). In this case, who gave that witness? As far as details of the case are known, her accompanying the stranger in that car was used as an evidence to object on the credentials of her character, this is absolutely against the rule precribed by the PROPHET(P.B.U.H), how can they do this?

N03.Even if I assume that the girl was proven guilty of her immoral involvement with the man, how can the judge increase the lashes from 90 to 200 out of personal grudge with the girl for influencing and aggravating the media ?

N04. When a man is found guilty of involvement in an act of fornication, he is punished with "stoned to death" that is when the girl is married and to be lashed at when the girl is unmarried. Then how come the rapist are not given anything even close to a death penalty? Rather they have been given only 2-9 years imprisonment, after all their act in no way confirms respect for the girl's modesty and shame? Are there political reasons for this, considering that the judge is appointed by the king?
why don't all muslims come out and lambast at this mockery that the QATIF GENERAL COURT is making of the sacrecy of SHARIAH LAW, only augmenting misconceptions in the minds of nonmuslims?

In almost all the penal laws of all countries, those who abet in commission of offence are also taken as offenders and these passive offenders too are punished equally with the active offenders.

Islam alone has strictly prohibited unwed sexual intercourse prescribing a punishment of publicly death by pelting stones/lashing and continuous severe punishment in hell. No other religion has treated unwed sexual intercourse by mutual consent so harshly; contrarily appreciated it. In Islam, a murderer may escape punishment if all the blood relatives of the murdered pardoned; but not the adulterer and adulteress. Those allowing, accepting and appreciating unwed sexual acts will certainly condemn this Islamic concept; and they should naturally do so.

Before inflicting such harsh punishment for unwed sexual intercourse, Islam laid several barricades. By observing them, the chances of adultery will decrease a lot. One who jumps all these hurdles and commits adultery will be punished for it.

Islam prohibits mixing of Opposite sexes and prohibits meeting in loneliness of female and male not related by blood and their tours, travels, picnics, etc. Islam restricts all chances of adultery.

The whole details of that case are not available to comment but it seems that the girl was travelling with strangers (not related to her by blood), & they allegedly committed sexual acts with her. Hence both parties are to be punished therefor, since had she not travelled and given them a chance of sexual acts, they would not have committed it. The girl therefore is liable to be punished with the active offenders for abetting their offences.

Members of opposite sexes, meeting/talking and enjoying together without wedlock with proud of their activities shall naturally oppose it but Islamic celar teachings are also appreciated by a lot.

Because If One Country Enforces Sharia,The Whole World Will See The Perfectness Of It And Every Muslim Country Would Want To Live And Abide By It,This,The Western World Cannot Let That Happen,Furthermore,If All Countries Rule By Sharia,They Would Want By Shari'i Rulings,A Caliphate,A Caliph,One Ruler Of Whole Islamic World, This My Friend,Will Make The Western Rulers Fear So Much One Cannot Imagine

And sacred laws or not, don't u think it would be better if all those religious freako judges just chilled?
I mean punishing a girl for talking to a stranger?
If the politicians insists on maintaining sequestration, wouldn't it be better for the man to receive the lashings and for the girl to be left alone?
Now that's what I would call a strict but at least "galant" society.

What do you think?

ps. Is the Shariah dictated by the Quran or is it a man-made law? thanks

Dear Brother

Saudi Arabia is called as an Islamic Country but it is not hundred percent Islamic.

I am well experienced with Saudi Arabia as I worked there for years. I was reprimanded by their Mutawwas just because I used to go and pray in a seperate group twenty Rakath Taraweeh in Ramadhan. They interviewed me with four Scholars on various topics, but Alhamdulillah I escaped Jail and exit from there, my family use to be with me there.

It is a Kingdom my friend and Kingdom is the First Bida' in Islam as per my understanding. But those Mutawwas religious scholars of Saudi as thery are called will criticize you stop you on various matters declaring it a Bida' but they will not talk about Kingdom as they are Paid Servants of the King.

We Muslims are helpless at present, Millions are taking refuge in Non Islamic Countries so as to become their citizens. Is there any so called Oil Rich Muslim Country, where you can migrate and become their citizens as Muslims?

What are you surprised. I mean I think it is great that you are angry about this, but people were murdered over cartoons !! Why do you think that the Muslim establishment would come to aid of this girl?? This would be VERY out of character, far worse things happen every day that Muslims ignore.

This a systemic and cultural problem.

I as a female, do not agree that the girl should be punished. I don't see how it could be the girls fault. She is wearing her modest attire not looking sexy at all. I told you before, men get turned on just by looking at a pretty face! OH God Almighty, why must women be treated so cruelly! Send your angels to protect the innocent ones! With all this violate talk about Muslims and their laws and how women are treated; its getting to be quite scary. As Allah is God Almighty, I don't believe that there would be any laws that are inhuman to man or woman. WHO IS BLASPHEMING ALLAH/YHVH/GOD ALMIGHTY? THEY MUST BE STOPPED!

Most of the child molestations are done By "Relative's" the people who know the gurl child........ u can collect any data anywhere.... from any part of the world.....

so quran saying Gurl shd only come out with relative's is quite suprising........ coz Relative's are the people who commit the sin in "MOST" cases....
