A tax refund can be captured for the following:
1. Unpaid taxes.
2. Any other government debt such as overpayments of Social Security and VA benefits, unemployment compensation, or loss, damage, or destruction of government property.
3. Unpaid child support.
4. Government backed student loans in default. Private or privately insured student loans are NOT subject to capture.
Judgments for private or commercial debts are NEVER subject to capture of income tax refunds. However if a lien has been placed on bank accounts for such judgments the money from the tax refund can be taken as soon as it hits the bank account.

One of the basic reasons for tax refund withholding is back money owed to the IRS due to child support,unpaid prior taxes,tax evasion,unpaid student aid loans,unpaid Social Security monies owed, just to name a few,but it's mainly our fault for not correcting or failing to comply to all terms and past agreements.

if you owe certain bills, like the hospital bill, your state check can be kept. if you owe back taxes or owe some other federal related money, like court-related, federal will be kept, too!
