that he and his dad were taking care of it...but we were sure as heck wrong....these tickets were issued in May one for nosie orandance and another for speeding without insurance. We called the court system and he has a warrant out for his arrest...we know he has to turn himself in, but we don't want him to miss thanksgiving and we don't have the money to pay the tickets off...My wife's family has a history with the law, but most of them are good honest people and it would be very sad if Khalid(my BIL) went to jail durning the holidays because his younger brothe is already serving time...Khalid is no crimminal, he just didn't know how urgent it was to pay the tickets off and he has been dealing with depression and schizophrenia this year....what should we do...the warrant has been put out today....???

most likely there is a bond set for the warrant. it may be a cash bond, but if he will turn himself in, he can be bonded out within minutes, will no longer have a warrant, and will be issued a new court date to see the judge on the tickets. this is the best way to do it. go to the station with the money to get out. they court can tell you how much the bond is.

also, most warrant officers will work with you if you turn yourself in and see that you get out quickly because it is a lot easier for them than coming to get you.

turning yourself in gets rid of warrants, and still lets you be home for the holiday.

Most likely it's a bench warrant for Failure To Appear. The difference is that, with an arrest warrant, the police WILL come to arrest him, but with a bench warrant, they will wait until they stumble across him by chance.

If it's a bench warrant, then wait and enjoy the holiday. But don't put him in a position where he could be stopped and checked for ID.

Once the holiday is over, that's a different matter. If you don't have the money to pay off the tickets, you're in a heap of hurt. Whether he turns himself in, or he's found by chance, he'll have to go through the arrest process, no choice. But he can get back out on bond.

Problem is, no bond company will touch him. So a cash bond is necessary, and that's a LOT of tickets racked up. Without the money, he may spend a few days in jail until his court time comes up.

Now, the good news is, he can't be remanded to jail simply for not having the money right away. A payment plan can be worked out, but he MUST stick with it. Failure to make payments can be Contempt of Court and, for that, he CAN spend jail time.

WARRANT AND BAIL? COULD BE OUT BY THE 22ND BUT CUTTING IT CLOSE.
CALL A LAWYER. SCHIZOPHRENIA IS A GOOD CAUSE IF DOCUMENTED AND BEING SEEN FOR IT THAT HE MISSED THE COURT DATE. HAVE HIM WRITE AN APPEAL TO THE JUDGE FOR HIM TO SETTLE THIS MATTER AFTER THE HOLIDAYS.

You need to stop worrying about it as you have no control over him. Anyhow, the solution you come to may not satisfy your brother in law. His father is concerned enough to help so he has support from a closer member of his family.

call the judge and explain his mental situation. The judge will probably give him community service anyway. I do not think you will have a problem.
community service can be as simple as cleaning up after church services or helping at a goodwill thrift store. Some may write it off with a couple of days of service

Tell him to be a man and face up to what he has done in the past. His problem is everyone makes excuses for why he does things. If he stands up for what he has done and take care of it maybe next year he can spend time with his family and be proud of himself.
