Well, let's do with "worst case" scenario. Your friend STARTS a fight outside a bar, Disorderly Conduct. He hits the victim and knocks him unconscious, Assault and Battery. He then kicks this guy and causes significant injuries, Aggravated Assault. If this guy dies, Manslaughter.

Let's say the other guy attacked him. Your friend simply defends himself. So far, so good. Your friend knocks the other out, still okay. Now your friend kicks the guy who has all these serious injuries. We are back to the Aggravated Assault charge.

The authorities do not have to charge your buddy right away. They can wait for some time to do so. but they won't; the hammer will drop on him soon enough. They may just be waiting to see how the other guy is recovering. If he makes a full recovery, you buddy might get a break. If this guy comes out damaged, your buddy might be toast.

By the way, he should expect the victim to sue him into bankruptcy.

DEPENDING ON STATES STATUTES? ASSAULT 1ST DEGREE /(BATTERY) FOR BROKEN SKULL, ATTEMPTED MURDER BRAIN CLOTS, ASSAULT SECOND DEGREE FOR BROKEN NOSE ETC.
SUSPECT BE CHARGED AS SOON AS THE FACTS IN THE CASE ARE GATHERED?

YOU HAVE NOT SAID WHY THIS HAPPENED?

Attempted murder, aggrevated assault, being stupid and spitting on the sidewalk.
