I have 2 questions , if I have some charge off accounts in texas and I move to oklahoma , can they start garnishing my wages? Also what happens to the charge off accounts after 7 years that have not ben paid ? Do they fall off the credit report ?

Like some of the other posters said, they cannot garnish until the get a judgment.

If they have not file yet and it has been about 7 years since you defaulted (plus depending on type of debt) you would be out of the collecting SOL for either state if it is a general money debt (credit card, etc). If they do file, use an affirmative defense of SOL in with your answer.

(If it is for child support or government types of loans - taxes, government backed school loans, etc.- then there is no SOL)

Yes the original charged off accounts, and any collectors trade lines for the original charge offs, will fall off your reports at the 7 year mark.

Balances that have been charged off cannot be garnished from your wages. The IRS can do wage garnishment and of course child support as it is court ordered. Anything else like credit card debt is off limits. Their only recourse is to report the negative info to one of the credit bureaus or all of them for that matter.

Your wages cannot be garnered simply for charge off accounts. Wage garnishment has to be a legal order and it can never happen without some sort of notice to you and/or if you're taken to court and you do not pay the judgement entered on the collector's behalf.

School loans and child support will haunt you where ever you go and they'll get their money one way or another and that's guarantee "garnishment". Credit cards delinquency and bankruptcy fall off the face of the earth but it takes 7 years before it is legally dropped from the records.
