Well my sister bought a cellphone off of craigslist but it turns out that the phone was stolen and cannot be activated cause it is stolen. Yes it was dumb thing of her buying it before asking for the esn number and verifying if it was a clean phone, but now it is too late. Well I want to help her recuperate her money by either getting the police on them or at least scare them that i have the police on them to the point of them giving the money back. The dumb thing of the seller is that the seller gave her his cellphone number and home address. With this info I want to file a police report but can I do such thing. Can you file a police report for someone selling you a stolen phone without the concern of the buyer that is stolen?

yes, this is called theft of property and fraud.

and if you know that you have stolen goods and do not report it, you can be arrested for receiving stolen property.

Yes, you can and should report it, and I am sure that your sister thought that it was discounted not stolen or that the seller may have needed money and that is why he was selling it, and she should tell the police exactly what she thought and give them the information on the seller. Do NOT APPROACH the seller, let the police handle it as they know what THEY are doing, and let the spent money be a lesson to your sister, that "if an offer looks too good to be true it probably is" She deserves to lose her money, but she has learned a valuable lesson in the process.

Yes. The police could track this guy down. I'm sure its not the thief/robber's first crime.

Your help could solve alot of crimes.

As a cop, I would appreciate someone coming to me with this info. I would not hold your sister for buying stolen goods, nor would the DA in my county go after her.

Have you tried contacting the cell provider for the phone? They might be able to pursue it a little better than you. At least call them and get their input. They have been wronged just as much as your sister and they probably have protocol established for just such things.

As for the money she put out you might waind up having to sue him in civil court.

BUYER BEWARE. BUT YES, BY ALL MEANS FILE A POLICE REPORT AND GIVE THE CELL NUMBER THEY CAN SET UP A STING OPERATION AND PROBABLY GET A NICE THEFT RING STOPPED.
