i bought the car off my sister. tried to put it under my name but the car wouldnt pass smog. i am now trying to sell it to a mechanic and he'll smog it. will the dmv let me sell it since i never got it smogged in the first place.

if you never registered it the sale needs to go from your sister to the mechanic. he can make the repairs and have it tested and complete the title transfer. you do not need to be involved.

Check with the DMV about exactly what to do in your state. What you will probably need to do is have your sister get a replacement title (since you already attempted to sign the first one over) then she can sell it directly to the guy at the garage.

It is not illegal to SELL a car that will not pass smog, it is illegal to REGISTER a car that will not pass smog. In Nevada, all you need to prove you sold the car is a bill of sale (and you must surrender the plates). You must sign over the title, but if the car does not pass smog it is the buyer's problem, not yours.

If you could not sell a car that didn't pass a smog test, you could not sell cars that don't run to junkyards or people who use the car for parts. That makes no sense, and is not correct.
