My father had a stroke and him and his wife were seperated. Well he lost his memory and can not do for himself so he stays with my grandmother and my aunts take care of him . He gets a check every month and the wife gets it. She does not spend any of it on my father and I was told because she is legally still his wife and that she is entitled to it. I do not know what to do but my dad is suffering. As his daughter do I have any rights

Try contacting your local Social Security office and letting them know what is going on, this sounds like fraud!

I would contact social security and explain the circumstances. Since your grandmother and aunt are the primary care-givers for your father they may have more of a chance at receiving your father's entitlements on his behalf. I don't know what kind of women would use their ex husbands money on herself, knowing that he should be receiving it for his medical condition. Sounds cold hearted to me. Seek help from social security and if all else fails seek legal aid to see if you would have a case in small claims court. Also keep all receipts for medicines and other medical expenses of your father's behalf in case you do wind up fighting this through the courts.

His care givers have rights for him,get a lawyerand talk to him about what can be done about this and how the checks could be sent to your or your grandmother so they can used for your father.because he is the ill person in this situation not his wife.

Why don't you talk to some offical in the social security department and see. That's sad but it goes on everywhere stories like yours.

Talk to D.S.S aboutit, some of it should be spent on him and whoever is his guardian should be getting the money.
