When a background check is run on a person, by an employer or school, if they have any military convictions or have received a bad conduct discharge from the military, will it show on the check?

Depends on how thorough the background check is. I can tell you from experience, some of the generic check systems do not access military records. However, many more will yield that undesirable information.

Be prepared to explain any possible fall out with your employer. Note too, that a General Discharge will often be over-looked as as a huge detriment. A dishonorable discharge can ruin you.

I have a cousin who was given a dishonorable discharge during the Viet Nam era -and- after several years of appeals (using attorneys and advocates,) he/they finally repealed his dishonorable in lieu of a General discharge.

Employers cannot directly access military databases as they are for officially classified government use only. However, depending on the severity of your offense, it may show up at a federal district courthouse level (I've seen even driving citations issued by military police at this level). My advice: Don't take assume they are not going to check and take the risk of omitting that information. That will really anger them after spending on a background check to find out you lied. If they are really interested in the skills your are bringing to the job position, they will be most impressed by your admittance of your past blemish, the circumstances surrounding it and how you learned your lesson.

Nope,

The only time your military service or record shows up on a background check, is if you are applying for a job that requires a security clearance.

If you apply for a job at a factory, etc, they have no way of finding out, that you ever served in the military.

Military records are sealed, they must have your permission in writing, before they are allowed to release them to anyone.

This is one of the biggest myths out there, that civilian employers can find out about your military record.

A conviction by a Military Courts Martial is a FEDERAL CONVICTION and stays on your record for ever. A Dishonorable Discharge (or Other Than Honorable) is listed on your DD-214 ubder "character of service". An employer can ask to see your DD-214 before or after you are hired.

Most of these people do not know what they are talking about on here. If you were court-martialed AND convicted, that shows up. Anything else, it does not show up. A civilian employer does not have access to that type of information. Only our wonderful and intelligent government has access to that.
