Yes. Both are summary offences and are therefore only triable in the magistrates court. The magistrates court have a very high conviction rate compared to the crown court. Last I read the mag. court convicts 80-85% of cases brought before them whereas the crown is about 42%. So looking at the odds you'll get convicted, but thats just looking at the stats. I dont know any of the facts of your case. On the other hand being in the mag court is good because they can only give you up to 6 months for each offence. So if you committed an assault (causing fear of unlawful force) and battery (applying unlawful force) then you'll have a maximum of 1 year in jail. Though the likelyhood is that you'll just get a community service order. So yes you can got to jail for an assault and/ or battery, but the likelyhood is that you wont.

"Assault" and "battery" are two separate common law offenses and they do not have an automatic minimum punishment, nor are they always necessarily illegal; it's a matter of degree.
For example, to pat someone on the back is "battery" yet it's unlikely you'd be convicted of it unless you did it extremely hard!
Both offenses, if succesfully prosecuted carry a maximum 6 months imprisonment and/or fine at the court's discretion. You can find more information below.

It depends on why you done it, and how bad the other party was, if it was a silly fight outside the pub Saturday night then probably not. My workmate assaulted his wife and battered her but all he got was a very large fine.

no they end up saying there is not enough evidence, i asulted a police officer im going to court i cant remember what day but i know is in november my solisitor told me that they are gonna give me two choices one is to do community service or the other one to attend to this youth club where they will help to reabilitate...so no ya cannot go to jail for it..or wotever i didnt got your question...
