My husband was phsically assaulted by my cousins husband. My husband picked me up from work Wed. night and as we drove out of the parking lot my cousins husband pulled in, jumped out of the car and slugged my husband in the face. My husband was in the vehicle and stayed in the vehicle the entire time. We called the police and they said they really couldn't do too much. My husband has a visible marking on his head and a lump from the incident. My cousins husband does not like my husband or myself because a few months ago he used to live with us and we evicted him and his wife because he was breaking the law while living under our roof. He has been harrassing us for several months. We have filed several police reports re: the harassment but nothing has been done to this guy. After the last incident we were going to file a restraing order but didn't because we thought he was finally going to leave us alone and he had not bothered us alone because the cops spoke to him that time.

The guy did admit to hitting my husband. Last I heard from the police the incident was forwarded to the DA. I called the DA but they still dont show anything about the assault as of yet. What steps should I take to make sure this does not fall through the cracks and that it does get followed through.

The previous harrasement has been death threats and he has thrown stuff at our car. Like I stated before we have serveral police reports documenting the incidents that have led up to this event. Everyone says nothing will probably happen to this guy, but if nothing happens does that mean he can keep breaking the law and there will be no justice?

Hate to disappoint you, but your cousin will probably be convicted and fined. After a bunch of court bs for him and your husband, I doubt he'll even go to jail. He'll just have to pay $400 bucks and will blame the bill on you and cry to another relative for help paying it.

But to give you the straight answer, the cop is usually the one to follow up with. If you have the DA's number, he would be the best person to tell you, but will probably be too busy to return a call to you. If the cop feels this is worth following up on, and you remind him, he'll bug the DA to keep things moving. Just don't expect anything close to justice.

If the police referred the case to the DA, the DA have got to be too busy to name you or would possibly not even prosecute the case. Nothing is preventing you from submitting a police document or asking the responding officer why you're now not listening to approximately your request to press costs (you'll most of the time signal their variety and fill out a field if you're soliciting for that the individual be charged).

Did your husband sign a warrant against the offender? If he hasn't he sure as heck NEEDS to.

If the police don't see a misdemeanor offense occur...they cannot arrest without a warrant.

To get the warrant your husband needs to file a warrant against the offender.

I don't see much happening with this in the courts until the warrant is obtained and signed by your husband...the victim!
