Oh goodness! Sounds like this girl has got herself in way too deep! She probably thinks she cant go back on what she has said! She has said this to show off, her parents have gotten wind of it and shes told them a pack of lies! There isnt really anything that you can do about this! Just hope that the young girl sees sense and tells the truth! If per chance that its true I would say that your brother would have come forward already and admitted having s*x with her!
At the end of the day 16 is still a child! Kids make these mistakes all the time! At 16 they're still unknowledgable to the law and whats right and whats wrong! Try getting as much info as possible to prove it didnt happen! Like where he was and who he was with when it was supposed to have happened! Or get a friend to talk to this girl and find out what really happened! And let her know how serious these allegations are!
Good Luck! I hope it turns out to be a happy xmas!

At the moment, it's their word against hers. But whether she enticed them or not is beside the point. She is underage and therefore not legally considered capable of choosing to have sex. Whatever the outcome of Police investigations, the 12 yr old girl is the victim. Your brother is 16 and therefore legally an adult. I presume his friend is in the same category so they're both at risk of prosecution. I suggest your brother and his friend get some legal advice quickly to find out just where they stand as regards the law in this particular case. The Police are the innocents in all this. They are just doing their job properly - trying to protect a minor. Whether she was raped or consented, it's still a crime. Even if your bro and his friend are the victims of a deceitful little minx who is going around boasting about having consentual sex with them, it's still a crime. The mitigating facts surrounding the incident(s) may be taken into consideration if they are found guilty. Did she run home in tears and get the Police involved immediately or did she wait a week laughing with her friends before her family found out? Has she accused boys before? Is she a natural liar and attention-seeker? Whatever, the Police are duty-bound to find out the truth of the matter and have resources to do so. The problem isn't going to just go away while you worry about it and do nothing. Your brother and his friend, your parents and the friend's parents should get some legal advice QUICK. It might cost a little for some preliminary advice, but it would be worth it for peace of mind.

To determine whether your brother did do this or not should be fairly simple. A DNA test is all it should take as she would likely have some part of him on her body. This girl in turn should it prove to be a false accusation could be charged with lying to the police, additionally your brother may have a case with a defamation of character suit against her. It is a shame some people try to pull this stuff, but remember... in the end the world tends to even out as it should.

Have they examined her? They should have been able to get semen / DNA samples if it were true?
Unfortunately, even if she did "force" herself on him and they did have sex, then he is still guilty of having sex with a minor and it would be his word against hers as to whether it was consenting (on both sides) or not!
She sounds like a bit of a troublemaker from what you have said, but there is always the risk that she could be telling the truth. I dont know her or your brother, so I am afraid that only your brother and her know the truth!
I do hope that things come right for you and your family though, best wishes!

If your right about her then it sound like she is an attention seeking little trollop.
To me it sounds like this girl is desperately trying to get the attention of her family, possibly her father, as she feels unloved by them. Her way to gain attention is to make up stories so people feel sorry for her and flood her with the attention she craves, she simply doesn't understand the trouble her lies can cause.
The other possible reason for her attention seeking is far to horrid to even contemplate.
I am not condoning what this girls has done but the truth will come out in court and she will no doubt get what she deserves.
As for your brothers situation someone in your family must keep a diary of events if this girl gets in touch, times, dates and results.
But try not to worry about it as if it does go to court then the truth will come out.
If your brother is innocent then he has nothing to fear.

simple answer she is 12, a minor, underage to have sex, your brother is 16 at the age to have sex, if your brother is innocent, then he has no worries, but you do need a very good lawyer. to solve this issue, same for his friend, sorry your xmas is ruined, and i hope this girl, is found out for her lies, otherwise your brother and friend could end up on the sex offenders list, may serve a prison sentence very sorry for you all you must all be fretting and your heads in bits, but get some legal help okay.

sounds like a nice girl, if she is accusing your brother of rape then she will have to have had a medical examination by a police doctor first to see if she has even had sex with anyone she will be questioned and her story of events will have to have no holes in it at all remember you have got to have an excellent memory to be a Lie or she will just trip herself up all your brother has to do is tell the truth Innocent till pr oven guilty dont let her spoil your xmas shes not worth it

Get a lawyer for your brother. Then, find out what day she says this occurred. Where was he? Does he have any witnesses about where he was? How long ago did this occur? Is it soon enough so that she could go to a doctor or hospital and get a physical exam to see if any evidence is on her?
Call a lawyer. She may have to be ordered to go get tested quickly for bodily fluids from your brother on her.

She is 12, he is 16 i'm afraid that he should have used a lot more common sense....
It is unlikely that the Police or the PF/CPS will proceed with this given her history, however, your brother has to step up to the fact that he should have said NO! loudly and repeatedly!!
