I was pulled over by a police officer the other night and i he gave me a ticket for not having my drivers license,open container (my friends, which he brought with him and also got a ticket), and driving with no lights. I have a valid license but i lost it, i have been using my passport as i.d for the past week. anyways the officer wrote the name that was on my insurance card which is my fathers name. since he wrote the wrong name down is the ticket void? i live in georgia

No, the ticket is not void. Go to court.

Maybe you need to check with your court clerk office. In my state they look for mistake like that and dismiss the charge/violation. Every state has different laws. The problem with you is that the cop used your Dad's name and it's possible that he can get in trouble. Also you never know if this cop use your fathers name on purpose.

Once I was written up for an open container, when I went to the court appearance date the judge dismissed the ticket right away. Because the cop was suppose to write the name of the beer, not open container. In my state a open container can mean anything, like a cup of coffee, a cup of water ect.

Your ticket is valid. The arcane legal precedent behind this stands when the name written does not sound like your actual name. The officer could misspell your name, and as long as it sounds right phonetically, your ticket stands. You can still fight the ticket, but not on this basis.

You would think a police officer is smart enough to use your passport for id instead of your insurance card but police get away with most mistakes. No mistakes for you, average citizen but the police, well gosh.

Go to court but point that out. Get a new driver's license before you go, they should suspend that charge.

Tickets/Citations "can" be amended in court to reflect inaccuracies.

Yes, if information is wrong then it doesn't apply because its wrong. If the date is wrong you can't be accused because on that date you didn't do that crime etc.. In New Zealand anyway.

It actually makes sence.
