My husband is a disabled veteran. He applied for SSD about two years ago and is finnally going to start getting it. My question is first will his kids also get a lump sum for the back pay and second will it go to their mother or us? I only ask this because I have been paying over $ 1000.00 dollers a month to cover his child support for the last two years and I don't think their mother would save the money for them anyway. My husband and I would like to use it to start a college fund for them.

Your husband's children will receive auxiliary benefits - both a lump sum as well as on-going benefits. Generally the auxiliary benefits will go to the legal guardian of the children.
Unfortunately, I do not believe that this award of SSDI auxiliary benefits will serve to offset your husband's child support obligations.
As far as using the SSDI auxiliary benefits to start a college fund, that is certainly a good idea - however, your H may need to go back to the State Court that issued the support order to require this use of that money. If it goes directly to the custodial parent, I don't think you have any right to direct how it would be used absent a court order.

Even if you listed yourself on it, the ex could call to have it changed. If you used someone to help your husband appeal, you should talk to them because they can provide even more help.

You need an attorney. When I got SSD, my parents got my son's money because he was staying with them while in high school and they asked SSA for the money. I had no say. It seemed to me that possession of the children is a big influence. Maybe it is a matter of being assertive. Go for it!

Please check with Social Security on that question. And, if need be, make a request that the monies be given to your husband, and to you, or set up specifically for college fund for the children.
If need be, get an attorney who specializes in Social Security claims-disability, etc. to help you on this. Take care.
