Me an husband split up a week ago. He has left state and when he did , he left behind alot of his tools and belongings. He told me to hold them for him! He will be back to get the rest of his things. Do I have to do this? Or for a certain amount of time? My plan for now is save all reciepts for the movers , the U-haul and each month on storage. Not to let these items go back to him until I am paid in full. Yet I am also covering my a_ss legally. any advise on this?

Send him a registered letter and inform him you are moving.
Let him know he needs to pick up his stuff yesterday, you are not his storage bin.

I don't know why you are being so nice about this? He should have taken his stuff when he left. Are you moving? did I read that part correct or not?

I believe if you notify him by phone/writing to cover yourself (legally) to give him a specific date and time to get his stuff out by, you will be covered.
Let him know if they are not picked up by then, they will be given away.

Do you really think after he's already "TOLD" you told hold onto them for you, he's going to pay you back for storage and movers? I think not.
He left it WIDE open on when he'd be back didn't he?

I would put my foot down and let him know if he wants them, he can either do one of two things.
1) Wire you the money for the movers and storge and U-haul.
2) Have the storage place fax him the rental lease. Do NOT put it into your name, it's his stuff, let him be responsible for it.
3) He can come and get it.
4) You notify him to come and get by say within 1 week or it's gone to salvation army pickup.

well I guess that's actually one out of four things. Sorry.

Do a free consult with an attorney and find out your real legal rights about this. You don't want to be stuck holding the bag financially by signing a lease with a storage unit do YOU?

and you don't need him taking you to court to cover the costs for these items because you know he's going to jack up the prices. so either way, you are going to pay.

I would think since he's the one who left and you can show a registered letter to come and get the stuff by and give a date, he will no longer have access to these items.
Oh, and put everything down in the letter that is there and take pictures.

I had to get a restraining order against my ex (which was for a year) and the court made me give him back everything that was his by a certain date, even though he tried to kill me.

Oh and FYI he took his list of items into the court and we had a huge fight because he listed things I had owned for 15 yrs. and we were only married for 3 yrs. he tried to list MY things. So I had to go through each and every item and inform the judge certain items were either not there or were MINE.

So please take pics. I don't know what the law is in your state, but do protect yourself both ways AND please please please do not sign a rental unit lease for him and prepay it.

Like I said the Rental Office will fax it to him. Then make him responsible for coming back and getting it there. Honestly if you do this and pay up front, don't be surprised if you don't get your money back because "DID HE AGREE TO THESE EXPENSES?" THAT may get him off the fees, I'm not sure, but if he wanted to fight it, he could say you agreed to hold onto his items untill he could get on his feet and make the trip back to get his stuff as long as it took... (See how he could lie against you?)

Good luck, in my opinion he should have already been back to get his stuff ....unless he's in the Military and been deployed. but still make him pay all up front. Western Union will get the money immediatly to you, just look them up on the internet, they are in most grocery stores for him and you, you can find the nearest for you both (to make it easy on him w/ no excuses) and if he refuses to pay up front....send him that registered letter and seek an attorney's advise on a FREE consult. (Oh and ask the attorney how much they charge per hour,just to show your interest)

Um, Wow; Katie really wanted to answer that one!

If he doesn't come quickly for the stuff, see if he can arrange for someone else to pick it up and hold it (his family/friends). Be careful about getting rid of anything; you are on the right path with saving all receipts and the certified letter is a good idea as well.

It really sucks that are at a very emotional point but have to think very unemotional about the whole business. Good luck!
