depends on which state you live in all the laws vary when it comes to intestate deaths. You need to go to an attorney and get the properties into probate. If he and your mother were still married the norm is that the spouse is assigned as the executor of the estate. If the children contest it then you can be possibly neamed equally if the court allows. Debtors will all be notified and have 90 days to respond. Once they have claimed and been paid out what is owed to them the rest of the estate is devided as decided by the executor/s of the state.

Anything that your dad owned all belongs to your mother. Period.
Your mother needs to make a will spelling all of her wishes out and appointing an executor for her estate.
She also needs to contact banks and other accounts to make sure that all the kids are named to receive these accounts should she pass... this will avoid probate.

Wa alaikum salam wa rahmatullahi wa barakatuhu. we would desire to consistently thank Allah swt by way of asserting syukur alhamdulillah who has created us in our very own function as brothers, sisters and as mom and dad.shall we no longer elect it consistent with our very own willingness.we are born devoid of taking no longer something and we can die devoid of something too different than our very own amal ibadah for the time of our lives right here in this earth. Jannah/paradise is under the ft of a mom if she committed her life for elevating and coaching her infants into good behaviour consistent with the Qur'an and hadith.the youngsters could appreciate, love and help their mom at the beginning and then their father thank you on your reminding us on the subject of the fortunate mom and her infants.
